Read the Serververse Terms of Service outlining acceptable use, service conditions, responsibilities, and policies for cloud, hosting, and infrastructure services.

These Terms of Service ("Terms") govern your access to and use of the Serververse website, client area, products, and services (together, the "Services"). By creating an account, placing an order, or using the Services, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using Serververse's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. If you use the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We may modify these Terms at any time. We will provide notice of material changes through our website or by email to the address associated with your account. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

2. Services Description

Serververse provides game server hosting, VPS hosting, web hosting, cloud computing, and related services as described on our website. Service specifications, including storage, processing power, bandwidth, and features, are as described on our website at the time of purchase. We may update specifications from time to time to improve the Services.

We may modify, suspend, or discontinue any part of the Services. Where a paid service is being discontinued, we will give reasonable notice where practicable.

Our Service Level Agreement (SLA) sets out our commitments regarding availability, performance, and support response times, and is incorporated into these Terms by reference.

3. User Accounts

To access certain features of the Services, you must create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You may not share your credentials with others.

You agree to provide accurate, current, and complete information during registration and to keep it up to date. We may suspend or terminate your account if the information you provide is inaccurate, outdated, or incomplete.

You are responsible for all content and activity on your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Payments and Billing

  • Fees. You agree to pay all fees associated with your use of the Services. Fees are exclusive of applicable taxes unless stated otherwise.
  • Recurring billing. Subscription-based services are billed on a recurring basis at the then-current rates. Billing cycles are monthly or annual, depending on the plan you select.
  • Billing date. Services are billed on a calendar-date basis, not according to the exact hour of activation.
  • Due date and suspension. Invoices must be paid by the due date. Services may be suspended at any time after the due date if payment has not been received. We may terminate services that remain unpaid.
  • Payment authorization. You authorize us to charge the payment method you provide for all applicable fees. If a payment cannot be completed, we may suspend or terminate your access.
  • Price changes. We may change our fees and payment policies by posting the changes on our website or notifying you directly. Changes do not apply retroactively and take effect at the start of the next billing cycle after they are posted.
  • Refunds. Fees are non-refundable except as expressly provided in our Refund Policy or as required by law.
  • Chargebacks and fraud. Please contact support before filing a payment dispute. A chargeback or fraudulent payment may result in immediate suspension or termination, and we may recover the disputed amount and related costs.

5. Prohibited Uses

You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Services or other customers. Prohibited activities include, but are not limited to:

  • Violating any applicable law, regulation, or third-party right.
  • Distributing malware, viruses, or other malicious code.
  • Unauthorized access to any system, network, or account, including port scanning and IP spoofing.
  • Denial-of-service attacks, or operating or hosting booter, stresser, or DDoS-for-hire services.
  • Phishing, fraud, or impersonation.
  • Sending unsolicited commercial messages (spam).
  • Hosting, distributing, or linking to illegal, harmful, or offensive content. Child sexual abuse material is strictly prohibited and will be reported to the authorities.
  • Hosting or distributing NSFW (Not Safe for Work) content, including pornography and other sexually explicit or adult material.
  • Mining cryptocurrency without our express written permission.
  • Reselling our Services without our express written permission.
  • Engaging in forex trading or related activities.
  • Using resources in a way that interferes with the performance of other customers or exceeds the limits of your plan.

Violation of this section may result in immediate suspension or termination without refund, reporting to the relevant authorities, and legal action where appropriate.

6. Suspension and Termination

You may terminate your account at any time by following the instructions on our website or by contacting support. You remain liable for all fees incurred before termination.

We may suspend or terminate your access immediately, without prior notice or liability, if you breach these Terms, if required by law or a competent authority, or where necessary to protect our infrastructure or other customers. We may also end your account for other reasons, with notice where reasonably practicable.

Upon termination, your right to use the Services ends immediately. We may delete your account and all associated data after termination or a prolonged suspension. We are not responsible for any data loss resulting from termination or suspension.

7. Your Responsibility for Your Data and Environment

You are responsible for your content, applications, configurations, and the security of your services, including keeping software updated and using strong passwords. You are responsible for keeping your own backups. Any backup feature we offer is provided as a convenience and is not a guarantee against data loss.

8. Intellectual Property

The Services and all related content, features, and functionality, including text, graphics, logos, icons, images, data compilations, and software, are the property of Serververse or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload, submit, or display through the Services. By doing so, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, modify, publish, and distribute that content for the purpose of providing the Services to you.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SERVERVERSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES RESULTING FROM:

  • ERRORS, MISTAKES, OR INACCURACIES OF CONTENT.
  • PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES.
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES.
  • ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY.
  • ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF CONTENT MADE AVAILABLE VIA THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE AFFECTED SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless Serververse, its officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of and access to the Services.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including any copyright, property, or privacy right.
  • Any claim that your content caused damage to a third party.

This obligation survives the termination of these Terms and your use of the Services.

12. Third-Party Services and Events Beyond Our Control

Parts of the Services depend on third-party providers, networks, and software. We are not liable for any failure or delay caused by events beyond our reasonable control, including upstream network or provider outages, large-scale attacks, natural disasters, power failures, or government or regulatory action. Our SLA describes the remedies available for downtime.
